This paper offers a conceptual exploration of the concept of FPIC - free, prior and informed consent - in the context of the extractive industries and the challenges it places on traditional forms of governance. It draws on existing theoretical literature on transnational governance and indigenous rights to propose that operationalising FPIC comes down to a negotiated form of justice between parties.
